New Immigration Policy

What's the 'New Immigration Policy'?

Introduced on November 1st 2023 in the Regulation of the Minister of Law and Human Rights No. 22 of 2023, new policy changes related to shares within Foreign Direct Investment (FDI) regulations in Indonesia took effect. This means that PT PMA companies applying for ITAS must pay attention to the number of shares owned by foreign nationals in their company structure.

What does the 'New Immigration Policy' entail?

For Limited Stay Permit (ITAS)

  • Directors/Commissioners must own shares of at least IDR 10,000,000,000
  • Shareholders without positions must have shares of at least IDR 10,000,000,000

Additional requirements for new applications or extensions of ITAS since November 1st 2023 include:

  • Ticket/E-ticket
  • Boarding Pass when entering Indonesia using Investor Visa
  • Company (PMA) Bank Statement for the last 3 months showing capital deposited in the company's account

For Permanent Resident Permit (ITAP)

  • Directors/Commissioners must have minimum shares of IDR 15,000,000,000
  • Shareholders without positions must own shares of at least IDR 15,000,000,000

PMA companies must also update share value and capital value in the Company Deed before a Notary following this new policy.

How long is the 'New Immigration Policy' transition period?

All ITAS applications and extensions follow the new policy effective January 1st 2025. However, new applications and extensions for companies with shares below 10 billion are temporarily allowed until December 31st 2024, with stay periods granted according to the visa type owned.
